USER REPRESENTATIONS
By using the Service, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms; (2) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use Service; (3) you will not access Service through automated or non-human means, whether through a bot, script or otherwise; (4) you will not use the Service for any illegal or unauthorized purpose; and (5) your use of the Service will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
By accessing or using the Service you agree to be bound by these Terms. These Terms apply to all visitors, users and others who access or use the Service. If you disagree with any part of the terms, then you may not access the Service.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Privacy Policy
Please read the privacy policy to make sure that you understand how we use the personal information you provide for before using the Service or submitting any personal information.
"Personal information " refers to your IP address, synchronization time and date, device location, direction and speed, battery status, access authorization of Bluetooth of mobile device, Unit ID, hardware and software version of infotainment system and any other information that may be used to directly or indirectly identify you.
You agreed us collecting your personal information from your mobile device and uploading it to server to synchronizing it to car device while you are using the Service.
Also, while you contact our customer service through e-mail, phone, and online service, we will collect your personal information, including but not limit to your name, date of birth and ID Card number.
Nevertheless, to deal and arrange the technical problems, to make a better service for our customer, we will record for all information above if needed. Furthermore, we may record and review the conversation between you and our customer service representative, also the opinion you initiatively provide to us. The reprehensive of service customer may log in your account while you agree to solve the problem you encountered.
Exclusions
We may need to disclose your personal information, if:
- In accordance with legal requirements, legal procedures, and/or requests from public agencies and government agencies.
- If the disclosure is necessary or appropriate for national security, law enforcement, or other matters of public importance
- In order to enforce our terms or protect our business, rights, assets or services, or to protect users, or if the disclosure is reasonably necessary for the following purposes (detecting, preventing and resolving fraud, unauthorized use of the service, violations of our terms or policies, or other harmful or illegal activities). (There may be occasions when we may collect, use, or disclose your personal information without your consent if it is and only to the extent it is permitted under applicable data protection laws).

INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the mobile application (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the mobile application “AS IS” for your information and personal use only. Except as expressly provided in these Terms, no part of the mobile application and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Our Service may contain links to third-party web sites or services that are not owned or controlled by (CARMAX COMPANY LIMITED).
(CARMAX COMPANY LIMITED) has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that (CARMAX COMPANY LIMITED) shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
DISPUTE RESOLUTION
Any legal action of whatever nature brought by either you or us (collectively, the “Parties” and individually, a “Party”) shall be commenced or prosecuted in the courts located in Taipei, the capital of Taiwan, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the courts of Taiwan.
